These Terms and Conditions (“Terms”) govern the access to and use of the website and services operated by Zahra Perfumes (“Company”, “we”, “us”, or “our”). By accessing, browsing, or placing an order through this website, the user (“User”, “you”, or “your”) acknowledges that they have read, understood, and agreed to be bound by these Terms, without limitation or qualification.

  1. The Company offers attars and perfumes, certain products of which may contain alcohol.

  2. All products are intended strictly for external use only.

  3. While the Company takes reasonable care to ensure product safety and regulatory compliance, individual sensitivity, allergies, or adverse reactions may vary.

  4. Users are strongly advised to conduct a patch test prior to regular use.

  5. The Company expressly disclaims all liability arising from:

    • Allergic reactions

    • Skin irritation

    • Improper use or application

    • Use contrary to provided instructions

Use of the products is at the sole risk of the User.

4. Pricing, Taxes, and Payments

  1. All prices displayed on the website are inclusive of applicable Goods and Services Tax (GST), unless stated otherwise.

  2. Prices, product descriptions, and availability are subject to change at the sole discretion of the Company, without prior notice.

  3. The Company accepts payments via UPI, debit/credit cards, Cash on Delivery (COD), and other modes as made available on the website.

  4. The Company reserves the unrestricted right to cancel or refuse any order, including after payment confirmation, due to pricing errors, stock unavailability, suspected fraudulent activity, or operational constraints.

  5. In cases of failed, duplicate, or excess payments, refunds shall be initiated after verification, in accordance with internal validation procedures and payment gateway timelines.

5. Order Processing and Shipping

  1. The Company provides delivery services within India only.

  2. Shipments are fulfilled through third-party logistics and courier service providers, selected based on serviceability and operational feasibility.

  3. The stated delivery timeline of 7–10 business days is an estimate only and shall not be construed as a guaranteed delivery period.

  4. The Company shall not be held liable for delays or non-delivery caused by:

    • Courier partner issues

    • Natural calamities

    • Government restrictions

    • Force majeure events

Risk associated with transit delays shall not entitle the User to compensation or damages.

6. Returns, Refunds, and Exchanges

  1. Returns of perfumes and attars are permitted only under limited and verified circumstances, as determined by the Company.

  2. Any issue must be reported within three (3) days of receipt of the product.

  3. Submission of a clear unboxing video and written communication via email or WhatsApp is mandatory for claim evaluation.

  4. The Company shall bear return shipping costs only in cases of defective, damaged, or incorrect products.

  5. In the case of product exchanges, all shipping costs shall be borne by the User.

  6. Approved refunds shall be processed:

    • To the original payment method, or

    • To the bank account provided by the User in COD transactions

  7. Refund processing timelines are subject to banking and payment gateway norms.

7. User Conduct and Restrictions

  1. Users shall not engage in fraudulent activity, abuse platform services, or misuse promotional benefits.

  2. The Company reserves the right to suspend or terminate accounts and cancel orders without notice in cases of suspected abuse or policy violations.

  3. Unauthorized resale, redistribution, or commercial exploitation of products is strictly prohibited.

8. Intellectual Property Rights

  1. All intellectual property, including but not limited to trademarks, logos, product names, images, text, and website content, is the exclusive property of Zahra Perfumes.

  2. No content may be copied, reproduced, distributed, or used for commercial purposes without prior written consent.

  3. Unauthorized use shall invite legal action under applicable intellectual property laws.

9. User Reviews and Content

  1. Users may submit reviews and feedback, subject to moderation.

  2. The Company reserves the absolute right to edit, restrict, or remove any user-generated content.

  3. By submitting content, Users grant the Company a royalty-free, perpetual, irrevocable license to use such content for marketing and promotional purposes.

10. Limitation of Liability

  1. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of the website or products.

  2. In no event shall the Company’s total liability exceed the value of the order placed by the User.

12. Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of India.

  2. All disputes shall be subject to the exclusive jurisdiction of the competent courts in Mumbai.

  3. The Company reserves the right to initiate dispute resolution through arbitration or court proceedings, at its sole discretion.
